Yours Excellencies in Brazil:

We, organizations and people from and outside Brazil, request that Rosivaldo Ferreira da Silva and his brother, José Aelson Jesus da Sila (Teity Tupinambá), arbitrarily arrested by the end of the morning of April 7 by the Military Police (PM) of Bahia in the Olivença District, municipality of Ilhéus, for denouncing the illegal extraction of sand in and around a water spring, a protected area in the village of Gravatá, be IMMEDIATELY RELEASED because they did not commit any crime.

The brothers were victims of an ambuscade conducted by the Military Police (PM) of the Bahia state, after they denounced the environmental crime, that already resulted in an embargo by IBAMA (Brazilian Federal Environmental Agency). Besides, the Southern region of Bahia faces nowadays one of its worst water crises of its history where in towns such as Itabuna water for basic consumption, such as drinking and cooking is scarce.

According to the commander of the Police (PM), the two Tupinambá brothers were impeding the way-out of trucks, called caçambeiras, full with sand extracted inside the village. The judge Lincoln Pinheiro da Costa, of the Federal Court of Ilhéus, who conceded the decision in favor of displacing the Tupinambás from the Gravatá village on January 12. This decision, implemented on April 6, had already determined that the PM would escort the trucks. About one week ago, these escorts were being done by the PM; nevertheless the Tupinambas maintained the denunciation of environmental crime and counted on the embargo of IBAMA.

In spite of the fact that one day earlier, on April 5, a suspension of the judge's decision of displacement of the Tupinambás had been negotiated, the PM used all its force to displace the inhabitants of the village of Gravatá, forcing them to hide themselves in the forest and in neighboring villages. The same Military Police that had been giving support to the environmental crime arrested, later on, Chief Babao and his brother at the Federal Police office, alleging that they were carrying a revolver caliber 38 for exclusive use of the police. Chief Babau and Teitê denied that the armed guns were theirs, what indicates that the weaponry was forged with the intention to incriminate and criminalize the Tupinambá leaders.

Already for some time, Judge Lincoln Pinheiro da Costa of the Federal Court in Ilhéus has been acting in a way of assuring that non-Indigenous can extract sand from the Indigenous Tupinambá territory in Olivença. He caused discord with the Tupinambá is by adopting an attitude of wanting to intermediate the conflict between the indigenous and non-indigenous people, responsible for extracting sand from the spring. The proposal of the judge is that the indigenous people can remain in the village Gravatá, only if they do not impede the extraction of sand.

The recent history of violence by the State against the Tupinambá is big, both from the big farmers as well as from gunmen, including arbitrary arrests, abuse of police force, torture, destruction of houses, community cars, food and school equipments. In that way the Federal Police imposed systematically pressure, supported  by court decisions or other justifications not very clear for the Tupinambás, so that the Tupinambás would leave their re-conquered territory. Especially chief Babau and his family have been targeted, resulting in an endless list of violence against the Tupinambá of the Serra do Padeiro territory.

We trust the Word of the Chief and his brother, because of his responsible behavior and defense of nature, his community and supporting groups and people, as well as the organized and just way he leads his community that supports him as a Chief. This allows us to DEMAND, that Chief Babau and his brother be released now!

Brazilian indigenous woman claim solidarity of indigenous relatives in the world

Dear indigenous relatives in the world,

The last years we have suffered the worsening of the abuses of indigenous rights in Brazil: in this land still struggle against the colonization process they call "progress" and "civilization".

Our territories are attacked systematically relying on the government's omission:

They delegitimize our right to our ancestral lands, sanctuaries where we were born and where our ancestors are buried, moving and leaving us on the roads.

Farmers promote shootings in our villages and camps, the main strategy assassinate our chiefs and spiritual leaders - shamans.

They use their power to manipulate the police and hire professional killers to make surprise attacks.

They poison our water with heavy metals and pesticides, use chemical and biological weapons to kill us slowly from disease and hunger.

This violence is not just from the large landowners but also by the government that in it's rush to build a unprecedented amount of hydroelectric plants in the Amazon, or expand agribusiness in our country, has omitted it's commitment to ensure our constitutional rights.

Currently in the National Congress they are trying to approve a constitutional amendment that would deliver the power of demarcation of our lands to the owners of the Brazilian agribusiness allies of large multinationals.

One of the regions with the greatest violence is in the state of Mato Grosso do Sul, region of cattle ranchers and soybean farmers: since 2002 they murdered more than 300 leaders from the Guarani and Kaiowá nations, this Wednesday killed a child in a shootout and during this week there was not a single day without a person being murdered.

That is the reality of many people in Brazil as the Terena, Munduruku, Pataxó Hãhãhãe, Kaingang, Guarani, Awa Guajá and other indigenous in every corner of Brazil.

We are desperately seeking to report on all international spaces, we ask for your help and cooperation to draw attention to the world.

This violence must stop.

#FreeTenharim: Ativistas ocupam saguão do Tribunal por liberdade para os índios Tenharim  - Trinta manifestantes acamparam por 12 horas no saguão do Tribunal de Justiça de Rondônia (TJ-RO), tendo deixado o local na manhã desta segunda-feira (23), após protocolarem um documento que pede a liberdade dos cinco indígenas Tenharim que estão presos em Porto Velho. 

Estudantes da Universidade Federal de Rondônia (UNIR), o indígena José Humberto Tenharim e ativistas das seguintes ONGs fizeram parte do grupo de manifestantes:  Instituto Madeira Vivo, Instituto Índia Amazônia, Movimento dos Atingidos por Barragens (MAB), Rede de Educação Cidadã, Conselho Indigenista Missionário, Coletivo Jovem pela Sustentabilidade, e Via Campesina. 


Iremar Antonio Ferreira, membro da ONG Instituto Madeira Vivo, de Porto Velho, e um dos organizadores da manifestação destacou ao G1 [matéria publicada em 23/06/2014] que: “Não há provas que confirmem a culpa dos índios, e o habeas corpus é um direito constitucional. Um deles tem sérios problemas de saúde, por conta de um acidente vascular cerebral sofrido pouco tempo antes da prisão. A justiça pediu comprovação via laudo médico, mas não há como comprovar porque a Casa de Saúde Indígena, em Humaitá, foi incendiada”. Sobre o incêndio da Casa de Saúde Indígena, leia aqui.

José Humberto Tenharim falou ao G1 da indignação pela prisão do cacique Domiceno Tenharim: “Ele é nosso líder maior. Nossos rituais estão comprometidos. O Mbotawa, que é a Festa dos Espíritos, deveria acontecer em julho, mas já não sabemos mais... Todo o povo Tenharim está sofrendo com isso, interfere no nosso modo tradicional de viver”. We're not allowed to have headdress nor practice our rituals. We can't either dance, paint, or anything related to our culture, our things. This is to our body too. Our body and our spirit suffer, we're worried a lot to our people there, in jail.

We are not treated as human beings here. But we are also Brazilian. We're weakened, we're hurt.

We didn't know what was going on. We can't stay here, knowing nothing, and our people can't stay without our rituals and ceremonies. It is a massacre of our spirits. And we have to do the funeral ceremony to our Chief. Without our festivities, everything gets unstructured. Our cerimonies must be done now, in July. If we can’t make them happen, the whole people, we're were all going to be unprotected. All the people will be spiritually unprotected, and then bad things will come, the rituals cannot be stopped, because they're done since the beginning of our people, and it never happened before that we couldn't do the cerimonies. Our people, our culture, everything gets disoriented, confused because we're here and our people is there, in prison. The whole community loses.

Open letter for the demarcation of the indigenous lands in Brazil

OPEN LETTER FOR THE DEMARCATION OF THE INDIGENOUS LANDS IN BRAZIL


We, the traditional leadership of the Kaingang people, leaders, professionals, youth, women, elders of the 305 Indigenous Peoples, who speak 274 languages and which make up 0,4% of the national population, with the support of indigenous organizations and pro-indigenous, of Brazilian citizens, of social movements and organized civil society denounce the Brazilian state, its executive, legislative and judicial powers for its 514 years of omission in favor of the annihilation of Indigenous Peoples, the expropriation of our lands, and the violation of our rights as human beings! 

Rio Grande do Sul is home to two of the greatest Indigenous Peoples in the country, making up this province as the 10th in the country population-wise: the Guarani People and the Kaingang People are, respectively, the 2nd and the 3rd biggest populations of Indigenous Peoples in Brazil (IBGE Census, 2010).

 The Kaingang are about 45 thousand people, most of which live in Rio Grande do Sul province and own the smallest indigenous lands of the country, confined in reductions of ancient traditional lands that today correspond to more or less 1% of the province’s territory, creating conflicts in which we defend our land’s right at the cost of lives whose losses are not reported in the media and the individualized criminalization of leaders that defend our collective rights constitutionally guaranteed but disrespected in a daily basis. 

The insufficiency of our territories has endangered our physical and cultural survival as Kaingang Peoples, whose language is under risk of extinction, following the UNESCO’s Atlas of the World's languages in Danger of Disappearing and the human development index that put the indigenous peoples as the segments under situation of social risk and show the omission of the Brazilian state in protecting the integrity of the Indigenous Peoples as distinct peoples, in accordance with the article 8 of the UN Declaration on the Rights of Indigenous Peoples. 

We fight in Brazil and abroad to get recognized our original right to land: a right that precedes the existence of the Brazilian state, at the expense of hundreds and thousands of indigenous lives, and we were successful: the Brazilian Constitution and the ILO Convention 169 recognize our right to our indigenous lands. A deadline of 5 years was established in 1988 and the year 1993 passed without the regularization of the indigenous lands in Brazil. 21 years went by and since then we have been fighting not to lose our recognized rights: we denounce the legal back-tracking currently in place the national Congress to eliminate our territorial rights and to bolster the interest of the agribusiness.  

We emphasize that the current government has the smallest indicators of indigenous lands’ demarcation since the military dictatorship and that the Brazilian judiciary, legislative and executive powers have violated the legality principle that mandates the state to respect and implement the right to consultation of Indigenous Peoples likely to be affected by juridical, political or administrative measures, through appropriate procedures and respecting representative institutions, under good will, in accordance with the ILO Convention 169. 

We express our concern with initiatives to restrict our lands’ rights, financed by the agribusiness, as per the proposal to constitutional amendment 215, which proposes the attribution to the legislative power activities that are prerogatives of the executive power, in the directive n. 303 of the Federal Attorney General's Office and all the legal and administrative initiatives biased towards diminishing or suppressing the territorial rights of indigenous peoples, in opposition to the spirit of the Federal constitution, the Indigenous Peoples Law (n. 6.001 of 1973) in its article 2, IX and the Decree 1.775 of 1996 and in violation of the article 26 UN Declaration on the Rights of Indigenous Peoples:  

1. Indigenous peoples have the right to the lands, territories and resources which they have traditionally owned, occupied or other- wise used or acquired. 

2. Indigenous peoples have the right to own, use, develop and control the lands, territories and resources that they possess by rea- son of traditional ownership or other traditional occupation or use, as well as those which they have otherwise acquired. 

3. States shall give legal recognition and protection to these lands, territories and resources. Such recognition shall be conducted with due respect to the customs, traditions and land tenure systems of the indigenous peoples concerned. 

We denounce the Brazilian government for each confrontation, for every death that has occurred and is likely to occur for the disputes over immemorial lands, demarcated by the blood of our peoples! 

We demand the compliance and the immediate implementation of our human rights previewed in national and international legal frameworks in conducting Indigenous Peoples related policies in Brazil. We demand that the Brazilian government promote, with urgency, in consultation and with the full and effective participation of indigenous peoples, a plan to regularize the indigenous lands in Brazil, with the proactive participation of the Public Federal Ministry, to ensure the compliance to the Federal Constitution of 1988, which recognizes the original right of Indigenous Peoples to our traditional lands and in accordance with the ILO Convention 169. 

Due to the absence of the Brazilian state in establishing a dialogue, we request to the United Nations Organization a visit from the UN Special Rapporteur for the Rights of Indigenous Peoples to Brazil, with a special attention the South and Central West regions, as a matter of urgency and the presentation of a report about the conflicts following the violations of human rights due to the delays in land demarcation processes in indigenous lands to the next session of the UN Permanent Forum on Indigenous Issues, the Inter-American Court of Human Rights and the International Amnesty. 

The Rio+20 final document is entitled “The future we want” and its paragraph 49 mentions the importance of the implementation of the UN Declaration on the Rights of Indigenous Peoples for sustainable development! Brazil intends to be one of the greatest economies in the world: but where are the indigenous peoples in the projects for the future of Brazil? What kind of future will we have if the indigenous lands are the condition for our physical and cultural survival? 

Our leaders, our people and organizations have submitted documents, have also conducted pacific manifestations, have traveled to Brasilia searching for solutions for these conflicts and have always received empty promises that were never fulfilled! Our leaders have been murdered and the medias do not even report these daily homicides against indigenous peoples, while the responsibles are not punished. 

Thus, this manifestation is a cry for help, to the urgent inquiry to human rights violations and the immediate implementation of the appropriate measures: judicial and administrative in favor of the survival and the future of our Peoples.

#FreeTenharim: State Public Defender demands Tenharim to be set free State. Public Defender points mistakes in investigations and demands Tenharim indigenous people to be set free.

The Public Defender of the Union (DPU) in Amazon demanded in Tuesday (03/11) a habeas corpus (release document) in Regional Federal Court of the 1st region in favor of the five native Brazilians of Tenharim ancestry accussed of manslaughter of three men by the end of 2013 in the Indigenous land of Tenharim Marmelos in Humaitá (Amazon). Besides the request of the annulment of the temporary jailing or substituting it by going to the “semi-liberty” regime in the Native National Foundation (FUNAI) the defense points mistakes in the investigation conducted by Federal Police Force therefore DPU assumed the defense of the accused in February.

According to DPU in Amazon – which released some parts of the release document (habeas corpus) – the police authority just based mostly in anonymous testimonies to finish the investigation which violates the International pacts of Human Rights of which Brazil is part and therefore the proof is invalid. Those people are free of the crime of “false testimony” and cannot even be contradict by the defense which denies the accused of the constitutional right of the contradictory to wide defense in the legal process. DPU asks for the exclusion of the documents containing the testimonies of such witnesses.

For DPU the investigation conducted so far is a failed attempt of two months work in a village where live 2 thousand indigenous Tenharim: “It were picked two natives – now seven with the indictment of another but who are still in freedom – by ‘anonymous witnesses’. Natives that were released just for the local community to feel justice – or revenge…”.

Ethnical prejudice

In the justice decision that determined the temporary jailing of the accused the federal public defenders in Amazon identified the discourse that says that the prison of the Tenharim where done to bring social peace “between different cultures”. “It’s a complex case which involves a wide territorial area and the investigation must be done with high care and sensibility because it is about a potential cultural conflict – natives and non-natives – that are living in times of high tension” said the responsible judge for the temporary jailing.
By the understanding of defense besides indicating that the tenharim men are arrested solely to satisfy the local community in Humaitá the words of the judge disguises and gives the impression of “judicial scientification of the case hiding ethnical prejudice and a colonialist feeling of eternal domination of the Indigenous tribes therefore camouflages the problem as if the temporary arrests were necessary for the investigations to go on”.

Freedom

In the request of temporary revocation the defenders pointed that there is no concrete proof that the accused – in freedom – threatened the witnesses or even damaged the investigations. If the request is denied then the Indigenous statute will be required in order that the temporary arrest will be changed to “semi-liberty” regime in FUNAI or a place determined by the organ. The DPU also asks for procedural seal.

Índios Tenharim e Jiahui sob ameaça de ataque e sem atenção do governo federal




Índios Tenharim e Jiahui sob ameaça de ataque e sem atenção do governo federal. A professora amazonense Gleice de Oliveira, em conexão pelo Facebook, conversou com uma liderança indígena Tenharim e uma liderança Jiahui. Gleice recebeu de Angelisson Japi'i Tenharin e de Nilcelio Jiahui denúncias de que eles se encontram sob ameaça constante e crescente de serem atacados na região - sul do Amazonas. 

Os indígenas relataram que souberam que 15 das pessoas que participaram de atos de vandalismo, na cidade de Humaitá, na noite de Natal teriam feito uma reunião na qual decidiram atacar os índios, inclusive com o uso de bombas. Na noite de Natal, os vândalos destruíram e queimaram equipamentos, veículos e barcos que prestavam serviços aos indígenas.

A notícia dessas ameaças chega às aldeias, deixando as comunidades em constante estado de tensão e intranquilidade. Por outro lado, os indígenas reclamam que o governo federal tem se negado a conversar com eles, a despeito de os indígenas terem buscado dialogar com as autoridades brasileiras.

Saliente-se, ainda, que os gêneros alimentícios básicos, enviados pelo governo federal aos indígenas por determinação judicial (após denúncia do Ministério Público), já começam a escassear. Os indígenas estão comendo apenas arroz e feijão, impossibilitados até de comprarem anzóis para pescar.

Climate of tension in Humaitá - #Tenharim conflict. Climate of tension in Humaitá, in South of the Amazon. Celebreations of New Year to have been cancelled.

Fearing a repeat of the violent events of Christmas, the city administration Humaitá in the southern Amazon, on Tuesday, the 31.12.2013, has banned New Year's outdoor parties.

Because of strong ethnic tensions in the region, the order was given at the request of the Task Force of the federal government, which also sent approximately 300 men in the region, including federal police and soldiers of the regular army.

"Today, if an Indian comes to town, he will die," says the lawyer Carlos Terrinha, the local representative of the OAB ( Brazilian Lawyers Association), former alderman and a sharp critic of the conduct of the Indians of the region.

The police presence on the streets of the city is obvious. Nevertheless, according to Francisco Merkel, the Bishop of Humaita, the few Indians who remain in the city, won´t go out on the street for fear of being attacked.

Recent news about the conflicts in the Southern Amazonas state, Brazil, by Elaíze Farias: 


Troops of the Federal Police arrived yesterday (27) in Humaitá. There were two meetings - one in the Town Hall and other in the Army barracks. The Tenharim Indians refugees in the barracks were not invited to participate in the meetings. 

Ivanildo Tenharim told me last Saturday that the Indians do not know clearly what actions are being planned and executed in yesterday’s conflict area, when hundreds of people made an anti-indigenous protest on the Transamazonic road, more specifically in the area where there were invasions of villages and fire in the toll base where Tenharim charge the road use. What is known is that the troops would enter into the Indian territory to "do a search" of the missing men (or their bodies) in the villages, since there is suspicion that Tenharim Indians would have killed these three people (which they deny). 

The other concern is the persistence of Indian people in the barracks. There is no prevision about the leaving of the 140 Indians from the place. The Tenharim are awaiting a response from Funai to resolve the case. In addition to these informations which we summarized here, Ivanildo gave me the following account:

"They did two meetings, but we did not participate. We just knew that they did the meetings, no Indians were present. We do not know what they are doing on the road: If they are going to enter into the village the village or they are trying to protect the Indians from the farmers’ protests. No Indian leader in the barracks is accompanying the troops at this time. Now we are waiting for the presence of Funai, that promised on Saturday to send a team here with us. We are isolated here in the barracks. We want to leave. It's too bad. It's that way of barracks, all we want to do we have to ask. We're not used to it. But we still do not know when we'll get out of here ".

This is the final decision of 5000 indigenous Guarani and Kaiowá to the Government, the Federal Court and to all national and international societies of the world.

Today on December 12th 2013, we, 5,000 indigenous Guarani Kaiowá from the Tekohá YVY KATU received news of another collective death threat, which is the order of violence against us and eviction of our land issued by the Federal Court of Justice of São Paulo - SP. 

Therefore, it is clear that the Brazilian judicial system will kill us all Guarani Kaiowá. With another eviction from the Federal Court, it is clear to us that the Justice of Brazil is authorizing the extermination of Guarani and Kaiowá, with all the violence , the collective death , especially the extinction and decimation of the Guarani and Kaiowá in Brazil.

We understand that in the past 10 years, the Federal Court of Brazil had several times declared our expulsion from our land YVY KATU, which means that the Justice of Brazil is ordering our death here in Yvy Katu. It's been two months since we communicated the Federal Court and the Federal Government that our communities had returned to reoccupy our tekoha YVY KATU to restore our lives in a piece of our land. We have also said that we will not leave our land of YVY KATU, here we will all die together, here we all want be buried. This is our final decision and we won’t change our mind. We have sent our message several times to the Federal Government and the Minister of Justice, to President Dilma, the Federal Prosecutor, the President of the Supreme Court.

Today, 12.12.2013, once again we have sent our final decision to President Dilma, the President of the National Council of Justice and the Supreme Court asking for the understanding and the fulfillment our past ultimatum. We demand from the supreme federal authorities in Brazil the following. We gathered four thousand Guarani and Kaiowá here at tekoha YVY KATU to resist the eviction order, our decision is to fight to death for our land of YVY KATU and even after our death we're not leaving YVY KATU.

We only ask the government of President Dilma and to Joaquim Barbosa, from the Supreme Court, to collectively bury us all here in tekoha YVY KATU. Neither living nor dead we will get out of our ancient land. While still alive, we anticipate our last wish to the Justice Courts, which is to have our right to be buried here in YVY KATU, we demand this request to the Brazilian Justice.

We also ask the president Dilma and the Federal Court that have ruled our expulsion and collective death to be the responsible in helping and supporting the surviving children, women and elderly here at YVY KATU that will definitely be without father and without mother after the execution of the eviction by the police force. Since the Federal Court of Navirai - MS in November, has mandated the use of police force against our lives and our strife, therefore we communicate the federal judge that we will resist until death the eviction order, we are absolutely sure that we will die for our land of YVY KATU, so the judge is already aware of our decision. All authorities are also now aware of our decision, as native Guarani people, we will fight to the death for our land of YVY KATU.

12/12/2013 Today, we have once again informed the federal judge of the Federal Court of São Paulo we will not leave the tekoha YVY KATU, here we will all stand and die fighting. We have equally communicated President Dilma. For the last time, we tell everyone that as of today 12/12/2013, we have started a rare religious ritual of farewell from our Earth life, in our belief, we are doing the conscious act of preparing life for the forced death by the white man’s firearms, or better said, we have begun our acceptance and confirmation ceremony regarding the forced exit of the soul from the body and its return to the Guarani cosmos due to the death on the battlefield. This is one of the life farewell rituals that is rarely performed, yet today we have started doing it. We have begun to participate in this ritual of acceptance of death and forced parting from life, from families and friends, because we know well that the Federal Court is authorizing the armed white men to attack and kill us here in tekoha YVY KATU. We inform everyone that we, Guarani and Kaiowá from YVY KATU, decided to resist eviction and to be killed by a firearm from the either white men or police force. There is no doubt in our heart. We will not retreat a step backwards, we will stand for the sake of honor and deep respect for our dead ancestors in YVY KATU, united, we will fight and die for our land where our ancestors are buried. For this reason, we ask the Government and Justice to bury us all here at tekoha YVY KATU because we aren’t leaving here either alive or dead, so we will not leave the tekoha YVY KATU. This is our final decision. Again, we invite all national and international societies to follow and watch the genocide and decimation of 4,000 native

Indígenas da Amazônia repudiam projetos do governo de exploração de petróleo

A jornalista Elaíze Farias, em seu blog, divulga notícias dos índios do Vale Jari, que repudiam projetos do governo brasileiro para exploração petrolífera em duas regiões da Amazônia:

Em nota divulgada nesta terça-feira (20), os indígenas do Vale do Javari, localizada no município amazonense de Atalaia do Norte (a 1.136 km de Manaus), repudiaram a proposta do governo brasileiro de desenvolver atividade petrolífera na região da Bacia do Juruá, nas proximidades daquela região. A bacia fica muito próxima da área de passagem (varadouro) dos índios marubo, da TI Vale do Javari. Também há registro de índios isolados.

Os indígenas também reiteraram a rejeição aos “projetos petroleiros” na área do rio Jaquirana, fronteira do Brasil com o Peru, onde vivem grupos de índios isolados e o povo mayoruna. A região do Vale do Javari é onde se registra o maior número de indígenas isolados do continente americano.

Eles “clamam” às autoridades para que estas os ajudem a participar de uma audiência com a presidente Dilma Rousseff. Eles também afirmam que não aceitam a realização de leilões anunciados há pouco tempo pela Agência Nacional de Petróleo (ANP).

A carta foi elaborada após realização de uma conferência na base da Frente Etnoambiental do Vale do Javari, no encontro do rio Ituí e Itaquaí, na semana passada. Participaram da reunião representantes dos povos marubo, kanamari, matis e mayoruna (matsés). A região também tem indígenas das etnias kulina e korubo.

Clóvis Rufino, do povo marubo, disse que, a partir de agora, a ameaça da atividade petrolífera na Terra Indígena Vale do Javari passa a ser a principal pauta de discussão dos indígenas. Novas discussões e reuniões estão sendo programadas para aprofundar o assunto e exigir do governo brasileiro uma resposta urgente. Leia a carta aberta na íntegra: 


CARTA ABERTA DOS POVOS DO VALE DO JAVARI SOBRE A AMEAÇA DE PROJETOS PETROLEIROS NO BRASIL E PERU

Nós, lideranças dos povos indígenas Mayuruna (Matsés), Marúbo, Matís e Kanamary, reunidos na Frente de Proteção Etnoambiental do Vale do Javari – FPEVJ, na oportunidade do Seminário dos Povos Indígenas do Vale do Javari, que tem como tema “Levantando Demandas, Discutindo Necessidades e Definindo Prioridades”, que foi a oportunidade de avaliação do nosso movimento indígena na retomada da luta pela nossa sobrevivência, atualmente ameaçada com projetos de grande impacto que desrespeitam as leis que nos protegem. 

Clamamos para que as autoridades representadas pelo Ministério Público Federal, a 6ᵃ Câmara, a Comissão Interamericana de Direitos Humanos e outros intercedam e exijam dos governos brasileiro e peruano a paralisação de qualquer atividade petroleira próxima a nossa terra e em especial próximo a área de ocupação de índios isolados.

Repudiamos qualquer proposta que possa impactar ambientalmente e socialmente nosso território e nossos povos. Não aceitamos o recente anúncio do leilão da Agencia Nacional do Petróleo - ANP para área no rio Juruá, próximo a nossa terra e de nossos parentes isolados.

Também não aceitamos os projetos petroleiros do governo peruano na região do rio Jaquirana, pois afeta índios isolados de ambos os países e a terra tradicional do povo Matsés, na fronteira Brasil-Peru, com poluição dos mananciais e do próprio rio Javari que afetará não somente os indígenas, mas as populações ribeirinhas que vivem na margem dele. 

Solicitamos do Ministério da Justiça através da FUNAI uma audiência com a presidente da república em Brasília – DF, para nos ouvir e apresentar nossa reivindicação.

Exigimos que o governo federal nunca tome decisão sobre o Vale do Javari sem antes nos consultar, principalmente no que diz respeito a qualquer projeto que impacta a terra indígena do Vale do Javari e seus povos, porque a presidenta Dilma Roussef não vem respeitando os diretos dos povos indígenas garantida na Constituição Federal e na 169 da Organização Internacional do Trabalho que prevê a “Consulta Livre, Prévia e Informada”.

Não queremos repetir a história que a Petrobras cometeu nos anos 70 a 80 na região do Vale do Javari, que destruíram nossas malocas, roças, dinamitaram nossos lagos e igarapés envenenando mananciais, causando morte de vários indígenas, contaminaram nossas aldeias com sarampos e DSTs, acúmulo de lixos na selva do nosso território, danificando a fauna e flora, trouxeram malaria para a região. Tudo isso foi encobertado até os dias de hoje.

E se a presidenta não nos ouvir, nós povos indígenas do Vale do Javari, iremos lutar contra a Agência Nacional de Petróleo, para tanto, estamos saindo do nosso seminário, mais do que nunca unidos, fortalecido e preparado para luta com todos os nossos povos.
